Bedz King LLC, doing business as Bunk Bed King (“Bunk Bed King,” “Bedz King,” “we,” “us,” or “our”), operates BunkBedKing.com and related services (the “Services”). Our store is powered by Shopify. This Privacy Policy describes how we collect, use, disclose, retain, and protect personal information when you visit or use the Services, make a purchase, communicate with us, submit a review or warranty request, or otherwise interact with us.

This Privacy Policy is intended to describe our online and offline privacy practices and the rights available to consumers under applicable law, including the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”).

Notice at Collection

We collect the categories of personal information described below to provide and improve the Services, process and deliver orders, provide customer and warranty support, maintain accounts and business records, prevent fraud, secure our systems, measure website and marketing performance, communicate with customers, and advertise our products.

We do not sell personal information for money. Certain disclosures through advertising, marketing, analytics, review, and similar technologies may, however, constitute a “sale” or “sharing” of personal information under California law even when no money is exchanged. California consumers may opt out through our Your Privacy Choices page at:

https://www.bunkbedking.com/pages/data-sharing-opt-out

or through a qualifying Global Privacy Control (“GPC”) signal.

We voluntarily extend this advertising-related data sale or sharing opt-out choice to all visitors located in the United States, including Washington, DC, regardless of whether their state law requires us to do so. See “Your Privacy Choices — Nationwide Opt-Out of Sale or Sharing” below.

We retain personal information only for as long as reasonably necessary and proportionate to the purposes described in this Privacy Policy, including order fulfillment, customer and warranty support, accounting and tax requirements, fraud prevention, dispute resolution, legal compliance, and maintaining opt-out or suppression records. Sensitive Personal Information

Depending on how you use the Services, Shopify or our payment, authentication, and security providers may process information such as account authentication information or payment-related information that may be considered sensitive personal information under California law.

We use and disclose sensitive personal information only as reasonably necessary to provide requested goods and services, process transactions, authenticate accounts, protect the security and integrity of the Services, prevent fraud, comply with law, or for other purposes permitted without a separate right to limit under the CCPA.

We do not use sensitive personal information to infer characteristics about consumers.

In the ordinary operation of our retail business, we do not intentionally collect biometric information used to uniquely identify a person, genetic information, health information, precise geolocation, Social Security numbers, government identification numbers, or information concerning race, ethnicity, religion, sexual orientation, union membership, or similar sensitive characteristics, except if a consumer voluntarily includes such information in a communication to us.

Sources of Personal Information

We collect personal information from the following categories of sources:

  • Directly from you, including when you place an order, create or use an account, contact us, submit a review, request warranty or customer support, subscribe to communications, or otherwise provide information to us.

  • Automatically through the Services, including through cookies, pixels, browser storage, device information, server logs, and similar technologies.

  • Service providers and contractors, including Shopify, payment processors, shipping and fulfillment providers, customer-support providers, review providers, security providers, and other vendors that process information on our behalf.

  • Advertising, analytics, and marketing partners, including platforms used for campaign measurement, audience matching, targeted advertising, analytics, and marketing communications.

  • Communications and customer support. We use personal information to answer questions, provide order and shipping information, handle service and warranty requests, and maintain our customer relationship.

  • Business administration and legal compliance. We use personal information for accounting, tax, recordkeeping, dispute resolution, enforcement of our terms, legal claims, and compliance with applicable law or valid legal process.

Sale and Sharing of Personal Information Under California Law

Bunk Bed King does not sell personal information for money.

California law defines “sale” and “sharing” more broadly, and certain disclosures through advertising, marketing, analytics, review, or similar technologies may qualify as a sale or sharing even when no money is exchanged.

In the preceding 12 months, we may have sold or shared the following categories of personal information for CCPA purposes:

  • Identifiers, including online, device, cookie, and similar identifiers and, where applicable, limited contact identifiers used for audience matching.

  • Personal information described in California Civil Code Section 1798.80(e), limited to contact information used for marketing or audience matching where applicable.

  • Commercial information, including product-view, cart, purchase, and product-interest information.

  • Internet or other electronic network activity information.

  • Approximate geolocation information derived from IP address or similar network information.

  • Inferences concerning product interests or preferences.

These categories may be sold or shared with categories of third parties that include advertising networks, social-media and advertising platforms, marketing platforms, analytics and measurement providers, and review or marketing technology providers.

The business or commercial purposes include cross-context behavioral advertising, audience matching, ad delivery, campaign attribution, analytics, personalization, and measuring the effectiveness of advertising and marketing.

Our Shopify Customer Privacy configuration is designed to stop supported sale- or sharing-qualifying technologies from collecting information when an applicable opt-out is in effect.

An opt-out of sale or sharing does not necessarily disable processing that does not constitute a sale or sharing under applicable law, such as ecommerce functionality, security, fraud prevention, transaction processing, and certain service or measurement operations.

We do not have actual knowledge that we sell or share the personal information of consumers under 16 years of age.

Disclosures for Business Purposes in the Preceding 12 Months

In the preceding 12 months, we may have disclosed the following categories of personal information to service providers or contractors for business purposes:

  • Identifiers.

  • Personal information described in California Civil Code Section 1798.80(e).

  • Commercial information.

  • Internet or other electronic network activity.

  • Approximate geolocation information.

  • Audio, electronic, visual, or similar information.

  • Sensitive personal information used for permitted transaction, authentication, security, or fraud-prevention purposes.

The business purposes for these disclosures include operating the Services, hosting and ecommerce functionality, payment processing, order fulfillment, shipping and logistics, customer and warranty support, reviews, analytics, security, fraud prevention, accounting, legal compliance, and other internal business operations.

Your Privacy Choices — Nationwide Opt-Out of Sale or Sharing

Bunk Bed King respects the privacy choices of all visitors accessing our website from the United States, regardless of their state of residence. We offer you the ability to opt out of the sale or sharing of your personal information for cross-context behavioral advertising or targeted advertising, as those terms are used in applicable U.S. state privacy laws, whether or not your state requires us to offer this choice.

You may exercise this advertising-related opt-out at any time by visiting:

Your Privacy Choices:
https://www.bunkbedking.com/pages/data-sharing-opt-out

We also honor qualifying Global Privacy Control (“GPC”) opt-out signals received from browsers and devices in all 50 U.S. states and Washington, DC. A GPC signal generally applies to the browser or device from which it is received. If Shopify is able to associate the device sending the signal with a customer account, the opt-out may also be applied to that account. You may need to enable GPC or opt out separately on other browsers or devices that you use.

No account, explanation, or identity verification is required to submit a browser-based advertising data sale or sharing opt-out. You may also contact us using the methods listed below if you need help exercising your privacy choices.

This advertising-related opt-out does not prevent us from processing personal information needed to operate our store, fulfill orders, provide customer service, prevent fraud, secure transactions, or comply with legal obligations.

Cookies, Pixels, and Similar Technologies

We and our service providers and partners use cookies, pixels, browser storage, server-side technologies, and similar tools to operate the Services, maintain carts and sessions, remember preferences, secure transactions, analyze website usage, measure advertising, provide reviews, and support marketing.

Our current technology providers include, among others:

  • Shopify

  • Consentmo (cookie consent and privacy preference management)

  • Meta, including Facebook and Instagram

  • Google and YouTube

  • Microsoft

  • Pinterest

  • Klaviyo

  • Fera

Their specific use of information depends on the service involved and your applicable privacy choices.

Some technologies are necessary to operate the Services. Other technologies may be used for personalization, analytics, or marketing.

Privacy choices vary by location. In 20 selected U.S. states, we display an upfront privacy notice offering a choice to accept or reject covered analytics and advertising processing. In the remaining 30 U.S. states and Washington, DC, an upfront notice is generally not displayed, and permitted analytics and advertising technologies may operate unless an applicable opt-out or qualifying Global Privacy Control signal is received.

All U.S. visitors can opt out of the sale or sharing of personal information for targeted advertising through our Your Privacy Choices page. We use Shopify's customer privacy controls to apply these choices to supported technologies and integrations. Necessary store operations and certain legally permitted measurement may continue.

Do Not Track

Some browsers offer a traditional “Do Not Track” or “DNT” setting. Because there is no universally accepted standard governing DNT signals, our Services may not respond to traditional DNT signals.

We do, however, honor qualifying Global Privacy Control signals from visitors in all 50 U.S. states and Washington, DC, as described in the nationwide opt-out section above.

Third parties providing advertising, analytics, or similar services through our Services may collect information regarding your online activities over time and across different websites or services, subject to applicable law and your privacy choices.

Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about access to and use of the Services in order to provide and improve ecommerce services.

Information submitted through the Services may be transmitted to and processed by Shopify and other service providers in countries other than the country where you live.

We also use Shopify features that may incorporate information obtained from interactions with our store, Shopify, and other merchants to provide and improve Shopify services.

In circumstances where Shopify determines the purposes and means of processing, Shopify is responsible for that processing and for responding to applicable privacy requests relating to that processing.

You can learn more in the Shopify Consumer Privacy Policy:

You may also use the Shopify Privacy Portal where applicable:

Bedz King does not ordinarily receive or store complete payment-card numbers entered during online checkout.

Payment providers process payment information in accordance with their own privacy and security practices.

Data Retention

We retain personal information only for as long as reasonably necessary and proportionate to the purposes for which it was collected or as required or permitted by law.

The criteria we use include:

  • Order, contact, and commercial information: retained as needed to fulfill transactions, provide customer and warranty support, maintain accounting and tax records, resolve chargebacks or disputes, prevent fraud, and meet legal obligations.

  • Account and authentication information: retained while an account remains active and as reasonably necessary afterward for security, fraud prevention, legal compliance, and account administration.

  • Customer-service, warranty, review, and communication records: retained as reasonably necessary to respond to requests, maintain service histories, administer warranties, moderate reviews, resolve disputes, and protect legal rights.

  • Analytics, advertising, cookie, device, and technical information: retained according to the purpose of the technology, applicable provider settings, your privacy choices, and our business or legal needs, and not longer than reasonably necessary and proportionate to those purposes.

  • Payment-related information: primarily retained by Shopify and payment providers according to transaction, fraud-prevention, legal, and financial-recordkeeping requirements. We retain transaction confirmation and related business records as necessary.

  • Opt-out and suppression records: retained as needed to continue honoring privacy and marketing choices.

Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, acquisition, destruction, use, modification, or disclosure.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Children's Privacy

The Services are intended for adults purchasing products for themselves or their families and are not directed to children under 13.

We do not knowingly collect personal information online directly from children under 13.

If we learn that personal information has been collected directly from a child under 13 without appropriate authorization, we will take reasonable steps to delete it.

We do not have actual knowledge that we sell or share the personal information of consumers under 16 years of age.

California Privacy Rights

Subject to applicable exceptions, California residents may have the following rights under the CCPA:

  • Right to Know and Access. You may request the categories and specific pieces of personal information we have collected about you, the categories of sources, the purposes for collection, sale, or sharing, and the categories of third parties to whom information is disclosed.

  • Right to Delete. You may request deletion of personal information we collected from you, subject to legal exceptions.

  • Right to Correct. You may request correction of inaccurate personal information we maintain about you.

  • Right to Opt Out of Sale or Sharing. You may direct us not to sell or share personal information as described above.

  • Right to Limit Certain Uses of Sensitive Personal Information. This right applies when a business uses or discloses sensitive personal information for purposes that trigger the CCPA's limitation right. We currently use and disclose sensitive personal information only for purposes permitted without a separate limitation request.

  • Right to Data Portability. Where required by law, information provided in response to a verified access request will be provided in a portable and, to the extent technically feasible, readily usable format.

  • Right to Non-Discrimination and Non-Retaliation. We will not unlawfully discriminate or retaliate against you for exercising privacy rights.

Privacy Rights for Residents of Other U.S. States

Depending on your state of residence, whether the relevant privacy law applies to Bedz King LLC, and any legal exceptions, you may have rights concerning your personal information in addition to those described for California residents above. These may include:

  • Access and Confirmation. Confirm whether we process personal information about you and request access to it.

  • Deletion. Request deletion of personal information, subject to applicable legal exceptions and retention obligations.

  • Data Portability. Request a portable copy of personal information where the law provides this right.

  • Other Applicable Rights. Withdraw consent or exercise additional rights relating to sensitive information, information disclosures, or automated processing where provided by law.

  • Non-Discrimination and Appeals. Exercise applicable rights without unlawful discrimination and appeal certain denials of privacy requests where provided by law.

Regardless of these state-specific legal rights or whether a particular law applies to us, we voluntarily offer the advertising-related data sale or sharing opt-out described in “Your Privacy Choices — Nationwide Opt-Out of Sale or Sharing” to all visitors located in the United States. You may also submit other privacy requests, or have an authorized agent do so where permitted by law, using the methods below. We will respond in accordance with applicable law.

How to Exercise Your Privacy Rights

You may submit a request to know, access, delete, or correct personal information using any of the following methods:

Email: info@bunkbedking.com

Toll-Free Telephone: 1-888-600-1225

Contact Us:
https://www.bunkbedking.com/pages/contact-us

All visitors located in the United States may submit requests to opt out of advertising-related data sales or sharing through:

Your Privacy Choices:
https://www.bunkbedking.com/pages/data-sharing-opt-out

or through a qualifying Global Privacy Control signal.

Please identify the privacy right you wish to exercise and provide enough information for us to reasonably locate the records associated with you.

For requests that require identity verification, we may compare information you provide with information already maintained in our systems. Information collected for verification will be used for that purpose.

We will respond within the periods required by applicable law.

Appealing a Privacy Rights Decision

If we deny all or part of a request to exercise a privacy right and applicable state law provides a right to appeal, you may ask us to reconsider the decision. To appeal, email info@bunkbedking.com with the subject line “Privacy Rights Appeal,” or call us toll-free at 1-888-600-1225.

Please identify the original request, provide its approximate submission date, and briefly explain why you believe our decision should be reconsidered. Do not send passwords, complete payment-card numbers, or other unnecessary sensitive information.

We will review your appeal and provide a written explanation within the period required by applicable law. Where these state laws apply, the appeal response period is generally 45 days for Minnesota (subject to any extension permitted by law) and 60 days for Indiana, Kentucky, Maryland, and Rhode Island. If we deny an appeal, we will provide information about how to submit a complaint to the appropriate Attorney General or regulator where required by law.

No new account is needed to submit an appeal. An advertising-related opt-out submitted through our Your Privacy Choices page or a qualifying GPC signal does not require this appeal process.

Authorized Agents

A California resident may designate an authorized agent to submit a CCPA request on the resident's behalf.

We may require the agent to provide evidence of authorization and may contact the consumer directly to verify identity or confirm authorization, except where applicable law provides otherwise.

Email and Marketing Communications

If you subscribe to marketing communications, we may send information about products, promotions, and Bunk Bed King.

You may unsubscribe from promotional email messages using the unsubscribe mechanism in those messages.

We may retain a limited suppression record so that we can continue honoring your unsubscribe request.

Even if you unsubscribe from promotional communications, we may continue sending non-promotional communications related to orders, shipping, customer service, warranty matters, account security, or other transactions.

California “Shine the Light”

California Civil Code Section 1798.83 permits certain California customers to request information about disclosures of specified personal information to third parties for those third parties' own direct-marketing purposes.

California customers may direct questions about this law to the contact information below.

Third-Party Websites and Links

The Services may contain links to websites or online platforms operated by third parties.

Their privacy and security practices are governed by their own policies, and we are not responsible for their practices merely because we provide a link.

International Transfers

We and our service providers may transfer, store, or process personal information outside the state, province, or country where you live.

Where applicable law requires a transfer mechanism, the relevant party will rely on an appropriate legal mechanism for the transfer.
